Terms and conditions
1. Booking and Deposit
A photography session is considered booked once a deposit has been received. The deposit secures the session date and is non-refundable. The remaining balance must be paid before or on the day of the session unless otherwise agreed.
2. Payments
Payments must be made using the methods accepted by Timeless Photography by Lou. Prices may change at any time, but confirmed bookings will keep their agreed price.
3. Cancellation and Rescheduling
If the client cancels a session, the deposit will not be refunded. Sessions may be rescheduled depending on availability. Clients are encouraged to notify the photographer at least 48 hours in advance whenever possible.
4. Delivery of Images
Edited images will be delivered digitally through an online gallery or download link. Delivery times may vary depending on the type of session but typically range between 1 to 3 weeks.
5. Editing Style
The photographer maintains full creative control over the editing style and final image selection. RAW or unedited files are not delivered unless previously agreed.
6. Copyright and Usage
All images remain the copyright of Timeless Photography by Lou. Clients receive personal usage rights to download, print, and share their images. Images may not be sold or used commercially without written permission from the photographer.
7. Portfolio and Promotional Use
Timeless Photography by Lou reserves the right to use photographs taken during sessions for portfolio display, website content, social media, or promotional purposes unless the client requests privacy in writing before the session.
8. Client Responsibilities
Clients are responsible for arriving on time for their scheduled session and ensuring that all necessary permissions or approvals for locations or venues are obtained.
9. Liability
Timeless Photography by Lou will take all reasonable steps to provide high-quality service but is not responsible for circumstances beyond control such as weather conditions, venue restrictions, or equipment failure.
Late Arrival Policy
Clients are expected to arrive at the scheduled session time. A grace period of 15 minutes will be provided.
After 15 minutes, a late fee of $50 may be charged. Delays exceeding 30 minutes may incur a fee of $100. Delays exceeding one hour may incur additional charges of $100 per hour.
Late fees must be paid before final delivery of images.
Sessions Time and Overtime
Session times begin at the agreed booking time and end at the agreed end time, regardless of the client’s arrival time.
Additional shooting time requested by the client is subject to photographer availability and will be billed at a rate of $150 per hour or portion thereof.
Outstanding Balances
Any unpaid balance, fees, or charges remaining after the session shall be considered overdue.
Timeless Photography by Lou reserves the right to pursue collection efforts, legal remedies, and recovery of reasonable court costs, filing fees, and collection expenses where permitted by law.
No-Show Policy
If a client fails to appear within 60 minutes of the scheduled session time without communication, the session may be considered abandoned and canceled. All deposits and payments made shall be forfeited.
Conditions Affected by Client Delays
Timeless Photography by Lou shall not be held responsible for reduced image variety, lighting limitations, weather changes, venue restrictions, sunset conditions, or other consequences resulting from a client’s late arrival or delay.
Non-Payment
Failure to pay the agreed balance constitutes a breach of this agreement. Timeless Photography by Lou reserves all rights available under Minnesota law to recover unpaid amounts.
10. Agreement
By paying any deposit or invoice, booking a session, or receiving photography services from Timeless Photography by Lou, the client expressly agrees to be bound by these Terms and Conditions. Failure to read these Terms and Conditions does not release the client from their obligations under this agreement.
